Themely Terms of Service

Welcome to Themely! These Terms of Service (“Terms”) govern your access to and use of the Themely platform (the “Service”), including our website and any related tools or services. By using Themely, you agree to these Terms. If you do not agree, please refrain from using our services.
1. Licensing & Usage
Themely assets are premium, curated design resources. By purchasing or downloading any product, you agree to the following terms.
1.1 What Is an End Product?
An End Product is a final, completed work that adds significant value beyond the original Themely asset.
Examples of Allowed End Products:
- Websites, mobile apps, and software where Themely assets are embedded in the design.
- Marketing materials such as presentations, social media graphics, and videos.
- Physical products like printed posters, merchandise, or packaging.
- Custom client projects where Themely assets are integrated into a broader design.
An End Product is NOT:
- A UI Kit, theme, or template that allows users to extract or edit Themely assets.
- A stock asset library or component pack that competes with Themely.
- A redistributed or resold version of Themely assets, whether modified or not.
Example:
1.2 Customer Permissions & Restrictions
You CAN:
- Create unlimited End Products for personal or client use.
- Embed Themely assets in client projects as long as they are not available for redistribution.
- Use Themely assets in projects that are not resold as templates or design assets.
You CANNOT:
- Resell, redistribute, or share Themely assets as-is, even if modified.
- Use Themely assets to create themes, templates, UI Kits, or component libraries for resale.
- Include premium Themely or third-party fonts in a downloadable product.
- Share Themely assets on private channels, bots, torrents, or other marketplaces.
1.3 Unauthorized Resale & Distribution
You may NOT:
- Upload Themely assets to other marketplaces or resale platforms.
- Share or sell Themely assets through private channels, bots, or third-party services.
- Claim Themely assets as your own work or attempt to resell them in any form.
Violation of these terms may result in account suspension, permanent bans, and legal enforcement.
1.4 AI & Machine Learning Restrictions
Themely assets may NOT be used for:
- Training AI models or machine learning algorithms.
- Generating synthetic content (e.g., AI-generated UI Kits, illustrations, or fonts).
- Incorporation into AI-powered design tools that modify, repackage, or generate variations of Themely assets.
- Uploading to AI training datasets, including but not limited to OpenAI, Stability AI, MidJourney, or any other generative AI platform.
Why? Themely products are curated, premium assets intended for human-centered design. Unauthorized use in AI training violates the integrity of our marketplace and the rights of our authors.
Violations may result in account suspension and legal action.
3. Refund Policy
Digital products are non-refundable.
- Individual product purchases are final and non-refundable.
How to Request a Refund:
- Contact us via Intercom support chat on Themely.
- Or email us at support@themely.dev.
All refund requests must be made within 14 days after the purchase date.
4. Account Management & Fair Usage
Security & Access
- Users are responsible for keeping their account credentials secure.
- Each individual license permits access on up to 5 devices/IPs.
Fair Usage
File sharing is strictly prohibited.
- Only the purchaser (license holder) may use the downloaded products.
- You may NOT share Themely files with colleagues, friends, family members, or anyone else.
- If multiple team members need access, they must purchase their own license or obtain a team license.
Violations of this policy, including unauthorized file sharing, may result in account suspension or termination.
5. Chargebacks & Payment Disputes
- Filing a chargeback may result in account suspension until resolved.
- Repeated chargebacks may lead to permanent termination.
- Themely reserves the right to dispute chargebacks with evidence (e.g., purchase history, IP logs).
If you believe you have a legitimate dispute, please contact us first:

Attempting to bypass our refund policy through chargebacks may result in loss of access to your account and purchased products.
6. Intellectual Property
Ownership:
- Authors retain full copyright ownership of their Items.
- Customers receive a license, not ownership of the content.
Themely Branding & Content:
- Themely's platform, branding, and interface are protected under copyright laws.
- You may NOT reproduce, modify, or repurpose Themely's design.
7. Governing Law & Dispute Resolution
- These Terms are governed by the laws of Dubai, U.A.E.
- Disputes shall be resolved exclusively in the courts of Dubai, U.A.E.
